Nine Pakistan Tehreek-e-Insaf-affiliated MPs demand recusal of chief justice in election tribunals case



Islamabad: Nine Pakistan Tehreek-e-Insaf (PTI) affiliated candidates contesting elections to various national and provincial council seats on February 8 made demands. Withdrawal of the Chief Justice of Pakistan (CJP) Qazi Faiz is hearing from the Isa bench on the election tribunal appointed in Punjab to resolve matters related to election disputes, The News International reported.
A five-member larger bench of the Supreme Court headed by the Chief Justice will hear the appeal. Election Commission of Pakistan (ECP) to set up Election Tribunal in Punjab against Lahore High Court judgment to resolve electoral disputes from February 8 general elections.
Apart from Justice Qazi Faiz Isa, the members of the bench are Justice Aminuddin Khan, Justice Jamal Khan Mandokhail, Justice Naeem Akhtar Afghan and Justice Aqeel Ahmed Abbasi.
On July 4, the Supreme Court stayed the LHC verdict and its notification on the appointment of eight election tribunals in Punjab. This stay was effective till the negotiations between LHC Chief Justice and ECP were completed.
In their petition submitted to the Supreme Court by the Registrar, the PTI-affiliated lawmakers sought permission to file their plea seeking the removal of Justice Isa from the bench hearing the election tribunal issue.
The nine candidates associated with PTI are Shaukat Iqbal Mirza, Raja Rashid Hafiz, Saad Ali Khan, Chowdhury Muhammad Nazir, Hasan Addel, Nasir Khan, Semabiya Tahir, Shehryar Riaz. These parliamentarians have been mentioned as defendants in the election tribunal case.
They informed the Supreme Court registrar that they sought to register a civil miscellaneous petition in the matter, requesting the chief justice to recuse himself from hearing the matter on some legal grounds.
However, they said the Advocate-on-Record (AOR) did not submit their application for reasons best known to the Advocate-on-Record and no communication was made in writing, reports The News International.
Then, they mentioned that they tried to register this application personally. However, the Institutional Branch of the Supreme Court office did not accept the application stating that it cannot be filed in person. Lawmakers said that should not stop them from calling for a fair trial of the matter.
They requested the registrar to allow them to appeal in person, as the matter is already scheduled for hearing on August 19. Meanwhile, defendant Salman Akram Raja’s lawyer Hamid Khan has requested for the matter to be adjourned, The News International reported.
Khan filed an application through Advocate on Record (AOR) Syed Rifaqat Hussain filed an application in the Supreme Court seeking a stay in the case. It is mentioned in the application that Hamid Khan will not be able to appear in court on August 19 as he is out of the country from August 16 to September 6.
